Section 14
Submission of claim, counterclaim, counterclaim or reply
(1) If the deadline for submission of claim is mentioned in the contract, within the same deadline and if no deadline is mentioned up to the name of the arbitrator, the arbitrator shall be appointed from the date of the dispute arising and if the arbitrator is appointed after the dispute has arisen. The claim must be submitted within three months from the date of occurrence. When submitting such a claim, the parties have to submit their claim in writing to the arbitrator along with the proof of what they disagreed with and what they want to be done, and a copy of the same must be given to the other party as well.
(2) After submitting a claim according to sub-section (1), unless otherwise provided in the contract, the other party shall submit a counterclaim on such claim within thirty days of receiving the claim.
(3) Within the time limit specified in sub-section (2), the other party shall also submit the counterclaim and any counterclaim in relation thereto, and if he also submits a counterclaim, the arbitrator shall give fifteen days to the party submitting the claim to submit a reply to such counterclaim and submit the counterclaim accordingly. If there is, a copy of the same shall be provided to the party submitting the counterclaim.
(4) If a party is unable to submit a counterclaim or reply within the time limit specified in sub-section (2) or (3) due to circumstances beyond its control, it may file an application before the arbitrator for extension of time within fifteen days from the date of expiry of such time limit, and the reason mentioned in the application. If necessary, the arbitrator may extend the deadline according to the request.
(5) When submitting a claim, counterclaim or counterclaim or reply according to this section, all documents related to the dispute and any supporting evidence, if any, shall be submitted. If the parties want something to be proved by a witness, the name, surname, and nationality of the witness must be disclosed in the claim, counterclaim, counterclaim or counterclaim, and the relevant party must bring such witness before the arbitrator on the day fixed by the arbitrator.
(6) In accordance with this Act, each party shall give copies of the documents filed before the arbitrator in connection with the proceedings of the arbitration to the other party.
(2) After submitting a claim according to sub-section (1), unless otherwise provided in the contract, the other party shall submit a counterclaim on such claim within thirty days of receiving the claim.
